1. Purpose
ImmunoCare focuses on giving healthcare advise and more specifically in context of oncology and immunotherapy. Immunocare wants to offer its knowledge and network of her specialists.
These terms and conditions govern the use of the online counseling service that provides medical information and guidance to Users through the ImmunoCare platform. The service aims to promote healthcare and more specifically oncology and immunotherapy knowledge and provide general supportive guidance based on information provided by the User. The service is expressly not intended to replace individual medical care, diagnoses and/or treatments. No medical records are established, no physical examination takes place and no medication prescriptions or referrals are provided.
The service provider reserves the right not to answer questions if they fall outside the scope of responsible online counseling, or if answering them risks misinterpretation. In such cases, the User is advised to contact a qualified medical professional.
Different phases can be distinguished in how ImmunoCare works. First, you fill out a submission form where you request a second opinion online and share your relevant medical information concering the case. Subsequently you will receive a confirmation acceptance and possible follow up questions. Our specialists will then review the case, after which there will follow a digital consult. After the consult you will receive a comprehensive second opinion. In case of the use of premium additional services, you will be able to discuss the report with your refered professional based on the matchmaking service.
Emergency and crisis situations (especially regarding medical or mental health issues) should not be directed to the Platform and should instead be referred immediately by phone or in person to qualified professionals. The Platform is not the appropriate medium for this.
2. Acceptance
These Terms and Conditions are a binding legal agreement between you and Future Clinical Trials Consulting, with registered office in Switzerland. “User,” “you” and ‘your’ refer to the person or entity using Immunocare's websites, applications and other offerings (the “Platform”). “Service provider” and “our specialist” are used as a general terms for the employees of ImmunoCare.
All references to “you” or “your,” as applicable, mean the person accessing, using, and/or participating in the Platform in any manner, and each of your heirs, assigns, and successors. If you are using the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity, your acceptance of the Terms shall be deemed an acceptance by that entity, and “you” and “your” herein shall refer to that entity, its directors, officers, employees, and representatives.
By using or otherwise accessing the Platform or clicking to accept or agree to these Terms, you (1) accept and agree to these Terms and (2) consent to the collection, use, disclosure and other treatment of information as described in our Privacy Policy and (3) you agree to comply with all rules, policies and disclaimers posted on the Platform or about which you are informed, and (4) you consent to the use of test results, base assessment documentation and other case information for research and educational purposes.
By using the service, the User agrees to these terms and conditions and privacy policy. The User consents to the processing of personal data and certifies that he/she is providing all information truthfully. The User also acknowledges that the service does not maintain individual medical records as a health care provider does. The User expressly agrees that he/she remains fully responsible for his/her well-being during and after the service. Only individuals who are at least 18 years old and can form legally binding contracts under applicable law of their jurisdiction are permitted to access the Platform or be a User.
3. Service
The counseling service is based on information voluntarily provided by the User and concerns general information. The service is not a form of individual care, does not diagnose or perform medical treatment. The advice is not intended to replace a visit to a doctor or specialist. In case of doubt or persistent complaints, a (family) physician or other qualified health care provider should always be consulted. Emergency medical situations are completely beyond the scope of this service and should not be directed to the platform.
Advice is given by default in English (or another pre-agreed language). The User is responsible for correctly understanding the advice given. If in doubt, it is recommended to seek clarification or consult a doctor or another qualified professional.
There are several types of service provided by ImmunoCare:

General oncology treatment plan: expertise in all types of cancer. Individualized assessments to develop tailored cancer treatment plans, ensuring each patient's unique needs are addressed which should be further discussed with primary doctor.

Second medical opinions: expert-driven insights & unbiased guidance. Receive a clear, research-backed second opinion to confidently explore all possible treatment paths that you will discuss further with your primary physician and in cooperation with him/her choose the best fit for your treatment.

Brain tumor expertise: exclusive access to advanced surgeries. Access to world-class neurosurgeons and innovative procedures not always available through standard care.

Immunotherapy treatment plans: personalized and scientifically backed. Facilitating access to advanced treatments.

Clinic matchmaking services: guided connection to the right care providers. Connecting patients with relevant clinical trials, offering opportunities to participate in pioneering immunotherapy research and access new treatments.

Caregiver & family support: 24/7 availability, emotional & informational support. Offer continuous support, including regular follow-ups and adjustments to treatment plans, ensuring optimal outcomes and addressing any concerns promptly.

Complimentory resources: Educational, practical & patient-friendly. Providing comprehensive materials to help patients and their families understand immunotherapy, treatment options, and manage expectations throughout the treatment journey.
On the one hand ImmunoCare provides a basic service in which ImmunoCare makes unilateral decisions to provide help through the platform. No remedy is available against these autonomous decisions. After acceptance by ImmonoCare, the User can expect a digital consult and written information which will be put into a report. Further referral is possible but not mandatory.
On the other hand ImmunoCare provides additional premium services alongside the basic service. The premium service includes the possibility of further follow-up. Depending on the agreements made between the User and ImmunoCare, further and longer follow-up is possible. Immunocare can however not guarantee follow-up after referral to a specialist since it focuses on referring and conveying information.
Our pricing depends on the complexity of each case and is not displayed online. We offer a free initial evaluation, and a member of our team will provide you with a personalized quote based on your needs.
4. Payment
A sign up fee will follow after acceptance of the case by our specialist. Basic service will be provided with the option for additional premium services, for which prior payment will be made. The payment is automatically charged to the User’s payment source provided on the Platform.The User guarantees the accuracy and legitimacy of the payment details.
The User and the service provider each have the right to terminate the advisory relationship at any time. Advice already provided cannot be modified or withdrawn after termination.
Once the service has been paid for and provided, no refunds can be made. If the User terminates the relationship, he/she is not entitled to a refund of the amounts already paid. If one of our specialists terminates the relationship, a refund will only be possible for services that have not yet been rendered, but no refunds can be made for advice or other services received. Only future payments can be cancelled.
5. Liability
The User acknowledges that the advice is based on limited information and that if information is incomplete or incorrect, the reliability of the advice decreases. The service can in no way be considered as individual medical service provision and is purely in the form of supporting health information. ImmunoCare provides a second opinion to be further discussed with an attending professional.
The service provider shall not be liable for any direct or indirect damages resulting from the use of the service, unless there is intent or gross negligence. If damages arise from the provision of incorrect, incomplete or misleading information by the User the service provider cannot be held responsible for this. For damages resulting from improper use of the service, misinterpretation of advice or failure to seek medical help, the User himself is liable.
It is the User's responsibility to verify the accuracy, completeness and usefulness of any advice, answer or other content available through the Platform.
Services and advice offered through the Platform are provided “AS IS” and without any warranty of any kind from Immunocare or others. No advice or information, whether oral or written obtained by you from Future Clinical Trials Consulting creates any warranty.
ImmunoCare has no control over medical specialists to whom her network refers (hereinafter: the referred specialist), you acknowledge and agree that ImmunoCare does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You also acknowledge and agree that ImmunoCare shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through the referred specialist.
6. Platform
The service is offered based on availability. The service provider does not guarantee uninterrupted or error-free access to the platform. In case of technical failures or maintenance, the service may be temporarily unavailable.
The content and structure of ImmunoCare's website are protected by copyright. The reproduction of information or data, in particular the use of texts, text parts or images, requires the prior consent of ImmunoCare. All right, title and interest in and to the Platform are and shall remain the exclusive property of ImmunoCare and its licensors. All materials therein, including, among others, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all intellectual property rights relating thereto, are the exclusive property of ImmunoCare and its licensors.
ImmunoCare reserves the right at any time to modify, suspend, discontinue or terminate, temporarily or permanently, with or without notice, the Platform or associated services (or any part thereof). You agree that ImmunoCare shall not be liable for any modification, suspension or discontinuance of the Platform.
7. Modification of terms
ImmunoCare reserves the right, at its reasonable and sole discretion, to modify or replace these Terms at any time. You are responsible for reviewing and becoming familiar with any such modifications. If we determine a revision to the Terms, in our sole discretion, is material, we will notify you as required by law. Use of the Platform by you after any modification to the Terms constitutes your acceptance of the Terms as modified. If you do not accept the changes, you must discontinue using the Platform.
8. General
Entire Agreement. These Terms (and any additional terms, contracts, rules, and conditions that Immunocare may post on the Platform), the Privacy Policy, constitute the entire agreement between you and ImmunoCare with respect to the Platform and supersede any prior agreements, oral or written, between you and ImmunoCare.
Waiver and Severability. If any provision(s) of the Terms is held by an arbitrator or court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and the other provisions shall remain in full force and effect. Immunocare’s failure to exercise or enforce any of the Terms shall not constitute a waiver of ImmunoCare’s right to exercise or enforce the Terms as to the same or another instance.
Assignment. You agree that ImmunoCare may assign the Terms to any other entity of its choosing, with or without notice to you. You may not assign the Terms to any other party for any reason, including, but not limited to, because your interaction with other Users of the Platform, the pricing offered, and fraud mechanisms in place are based upon individual usage.
Section Titles. The section titles in the Terms are solely used for the convenience of the parties and have no legal or contractual significance.
Notice. ImmunoCare may give notice by any means of communication reasonably anticipated to notify you of the information provided. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing or be delivered in a particular manner. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form. It is your obligation to update your Account information so that we may contact you as may be necessary. Such notice shall be deemed to have been given 48 hours after dispatch. If physical notice is used, then such notice shall be deemed to have been given 7 days after dispatch.
No Third-Party Beneficiaries. You agree that, except as otherwise expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms.
9. Prohibitions
As a User of the Platform, you agree that you will not use the Platform for purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by ImmunoCare. By way of example, and not as a limitation, you agree not to:

Use the Platform for purposes of plagiarism in any context or in cheating in the academic setting;

Directly or indirectly submit any information or otherwise engage in conduct that is fraudulent, inaccurate, infringing, libelous, defamatory, abusive, offensive, obscene, pornographic or otherwise violates any law or right of ImmunoCare or Users or any other third party, including privacy rights, copyrights, or other intellectual property right;

Use artificial Intelligence robots on our website

Scrape, access, monitor, index, frame, link, or copy any content on the Platform by accessing the Platform in an automated way, using any robot, spider, scraper, web crawler, or using any method of access other than manually accessing the publicly-available portions of the Platform through a browser or accessing the Platform through any approved mobile application, application programming interface, or user application;

Decompile, reverse engineer, or otherwise attempt to obtain the source code or underlying ideas or information of or relating to the Platform;

Violate the restrictions in any robot exclusion headers of the Platform, if any, or bypass or circumvent other measures employed to prevent or limit access to the Platform;

Submit any information that advocate illegal activity or discuss illegal activities with the intent to commit them;

Engage in any activity that could cause ImmunoCare to violate any applicable law, statute, ordinance, or regulation;

Resell or make any commercial use of our system or the content on the Platform, including personal information, without our prior written consent;

Provide information on any other websites about ImmunoCare, unless you expressly state that your statements are not made on behalf of and have not been approved by ImmunoCare;

Falsely imply ImmunoCare’s endorsement, partnership, or otherwise mislead others as to your affiliation with ImmunoCare;

Use the Platform in a way that violates or facilitates violations of these Terms, any other agreement or guidelines that govern use of the Platform or attempt to do any of the foregoing directly or indirectly.
10. Data processing
All data provided will be processed in accordance with the General Data Protection Regulation, the Swiss Data Protection Act and our privacy policy. Data will be used exclusively for the performance of consulting services and not shared with third parties without explicit consent, unless required by law.
11. Applicable law and disputes
These general terms and conditions are governed by Swiss law. Disputes arising from the use of the service are preferably resolved by mutual agreement. If that fails, disputes shall be submitted to the competent court in Switzerland.
